Full Defense Jury Verdict – Employment

Securing a full defense jury verdict as co-chair in two-month long pregnancy discrimination trial initiated by former employee who was terminated while in her eighth month of pregnancy. The case involved nine separate causes of action for FEHA sex and pregnancy discrimination, discrimination in violation of Pregnancy Disability Leave Law, disability discrimination, failure to accommodate, failure to engage in the interactive process, retaliation, interference with Pregnancy Disability Leave, failure to prevent discrimination/retaliation, and wrongful termination in violation of public policy.

Full Defense Judgment – Breach of Contract

Securing a full defense judgment as co-chair in real estate breach of contract trial. The case involved ten separate causes of action including four beach of contract claims, as well as claims for specific performance, breach of the implied covenant of good faith and fair dealing, two claims of negligent misrepresentation, tortious interference with contract, and declaratory relief. 

Full Summary Judgment – Class Action

Securing full summary judgment victory in favor of defendant in class action lawsuit alleging violations of the Fair Credit Reporting Act. Defendant was a national trucking company with a putative class size of well over 100,000 employee applicants during the class period (with potential liability in the eight or nine figure range).

Other Litigation Successes

Securing many favorable resolutions for employers in defense of wage-and-hour class action and PAGA representative lawsuits involving claims of unpaid overtime, meal and rest break premiums, unpaid minimum wage and off-the-clock work, unreimbursed expenses, itemized wage statements, and unfair competition.

Securing many favorable resolutions for employers in defense of single-plaintiff lawsuits involving claims of discrimination, harassment, retaliation, wrongful termination, failure to accommodate, and failure to engage in interactive process claims.

Securing many favorable resolutions for businesses in defense of ADA public accommodation lawsuits claiming that one or more disabled persons were denied full and equal access.
